Quarantine Act Charade - Final Nail in Its Coffin

What, why, and how they are trying to force on Canadians is all illegal. Do not fall for it.

This is the continuation from “Quarantine Act Charade Is Gaslighting Canadians” and will, hopefully, provide the last nail into the coffin of the dead-born child of the WEF and the Canadian government’s unholy matrimony, namely, the repressive acts committed on Canadians in the name of public health and the three-year-long fight against Covid-19 through the border quarantine measures. As if more that 50% of Canadians haven’t been infected with it already, and over 80% repeatedly vaxxed. It’s all make-pretend, the measures here to stay “for your added protection” and “out of the abundance of caution”. I.e., turning a Canadian democracy into a soft-and-cuddly dictatorship, colourful socks encouraged.

As has been said before, we’ve identified four reasons why the mandated measures at the border, like the compulsory arrival Covid-19 testing, ArriveCan mandatory use, and forced disclosure of your medical and other private information under the threat of astronomical “contravention” tickets for the violation of “Orders in Council” under the Quaranine Act Section 58. And the reasons are, briefly:

• SARS-CoV-2 virus is endemic in Canada for years, so quarantine measures at the border are futile and completely useless in preventing the introduction or the spread of said virus in Canada, therefore totally unjustified.

• the astronomical tickets written by public health officers at border crossings for “contraventions” of said mandated quarantine measures is in violation of government’s own regulations, namely “Regulations Amending the Contraventions Regulations (Quarantine Act): SOR/2020-86” Read “"Regulations Amending the Contraventions Regulations": I Stand Corrected!”

• the PHOs at border crossings have no authority to write and serve those tickets, as per Canadian law as only the police force is entitled to enforcement of federal laws

• notwithstanding all of the above, the border measures and astronomical tickets contravene the Canadian Bill of Rights Sections 1(a), 1(b), 2(a), 2(b)

And now to the last reason why all of this is a charade. According to the Transport Canada “BORDER MEASURES - GENERAL” web page:

Enforcement

PHAC undertakes compliance and enforcement to ensure that travellers are abiding by the requirement to isolate/quarantine for 14 days. In those instances, where compliance cannot be confirmed, PHAC refers these travellers to the RCMP for compliance follow-up. Maximum penalties for failing to comply with an order under the Quarantine Act (e.g. the Quarantine, Isolation and Other Obligations Order) include a fine of up to $750,000 or imprisonment for six months, or both.

Additionally, the Contraventions Act gives law enforcement partners (including RCMP, provincial and local police) the enforcement power to issue tickets to people who do not comply with the Quarantine Act, with fines of up to $3,000 for different Quarantine Act offences (this does not apply in AB, SK and the territories, as these jurisdictions have not signed on to the contraventions regime).

You can see what they are trying to do here: use the Contraventions Act to use provincial police forces in enforcement of the Quarantine Act measures under “Orders in Council”. Except, by their own admission, Alberta, Saskatchewan and the territories did not sign up for it. This leaves the Contraventions Act working on one half of Canada, and not working on the other half of Canada, in enforcing federal regulations and contraventions (i.e., pecuniary in lieu of criminal punishments)? That is as clear violation of equal treatment under the law as there can be, under the Canadian Bill of Rights, Section 1(b):

Recognition and declaration of rights and freedoms

1 It is hereby recognized and declared that in Canada there have existed and shall continue to exist without discrimination by reason of race, national origin, colour, religion or sex, the following human rights and fundamental freedoms, namely,

• (a) the right of the individual to life, liberty, security of the person and enjoyment of property, and the right not to be deprived thereof except by due process of law;

• (b) the right of the individual to equality before the law and the protection of the law;

Which makes the whole Contraventions Act null and void. Full stop.

Which makes any tickets you might receive at the border, called for by the “Orders in Council”, null and void too, be it from the PHAC PHOs or from the provincial law enforcement.

And that is the final nail, my friends, that should help us put these measures where they belong - in the garbage dump of history.

The question remains what should be done to the perpetrators and enforcers of these illegal measures. I leave it to the law professionals and politicians, for now. They did not do what they are supposed to do for too long already, did they?
